You must have discovered or received news regarding H-1B visa scraped or Immigrants comes back to their country or green card limits blocked and so on... But why it is in news these days and what is this H-1B visa? Let's explore it from the beginning.

 

 

 

WHAT IS H-1B VISA?

  • The H-1B visa is an employment-based, non-immigrant visa given by the United States companies to employ graduate-level workers for special occupations such as IT, Finance, Accounting, Architecture, Engineering, Mathematics, Science, Medicine, etc that require theoretical or technical expertise from other countries for a certain period of time.

  • One requires a bachelor's or higher degree or any equivalent degree for that occupation.

  • One gets an H-1B visa for an initial 3 years and can be extended to 6 years.

  • It was intended to help American firms deal with labor shortages in rapidly expanding jobs.

WHY PEOPLE APPLY FOR THIS VISA?

  • The non-immigrant visa allows an employer to easily seek for a US Green Card and thereby heading towards permanent residency after working for 5 years in the US.

  • The H-1B visa is popular among the companies as it assists them to hire employers from other countries at a low rate with highly skilled communication skills. These benefits, the company and the employers from India and China..

WHY H-1B VISA IS IN NEWS?

 

The H-1B visa helped the employers or companies to hire foreign citizens at a low rate awarded with the most-skilled or highest-paid beneficiaries. But, U.S. President Donald Trump in April 2017 spoke in his election speech to offer more employment to the Americans and used a tagline "Buy American, Hire American". Since then the companies, employees, and students are trying to adjust within a new climate atmosphere.

 

This new evolving climate has rejected many H-1B visas and holdings on its processing. As per the recent update from the Department of Homeland Security, there is a 32% denial rate in H-1B petitions implying fewer foreign employees. U.S. Citizenship and Immigration Services reports show that the reduction is intentional that means the effort hasn't considerably lowered the number of H-1B visas and many of the denials are overruled. The number of applications hasn’t dropped by much, and the employees will, however, apply every year. But the administration is clearly trying to reduce the inflow of skilled workers.
